We put up this site so you can get your hands on some great PlayStation products and other items we think you'll like. We also provide you with some interesting and helpful information and give you a chance to chat about things on our Message Boards. So take a good look around and enjoy our site. From time to time, we offer you goodies for downloading--feel free to download any this stuff you find especially interesting, as long as it's for non-commercial, personal use. This means you can't give copies to your friends, display it publicly, or charge anything for it (among other things).

Don't forget, you're legally obligated to the terms and conditions the legal team has asked us to list below as well as any other law or regulation that applies to this site, the Internet, the World Wide Web or the State of California. You shouldn't bother to hang around if you're not comfortable with these rules, 'cause once you're on our site (and that means anywhere on our site), you've got to follow these terms and conditions:

We cover most of the general rules about visiting our site on this page. However, there is a lot of important information that you won't find here, but will see in other places on our site dealing with specific issues. This includes the terms and conditions for buying stuff from us and checking on your order, information on our privacy policy, and stuff like that. So, even if you don't see it here, if we've included it on the site, it does apply to you! So pay attention to what we say along the way.

We try to avoid putting those annoying ®, ©, and ™ marks and loads of itty bitty type on every page, but we're telling you now that everything on this site is copyrighted and trademarked by us or one of our partners, unless we say otherwise. This means you can't just use the stuff (no matter how amazing it looks) without our written permission. And we've got to be honest up front: even if you came up with a totally cool idea that we were really excited about, it's not very likely our lawyers would let you use our stuff, even if you asked nicely. This may sound familiar, but it's important, so we're going to rephrase it. Anything on this site--pictures, drawings, text, games, anything--is either our property or the property of someone who gave us the permission to use it. Counter Notification to Alleged Copyright Infringer

If a copyright infringement notice has been wrongly filed against you as a result of mistake or a misidentification of the material, you may file a counter notification with our Designated Agent. The counter notification must provide the following information:

Physical or electronic signature of the subscriber;
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
The subscribers name, address, telephone number and email address, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of such person.
SCEA will terminate the registration of all account holders who are repeat infringers of intellectual property laws.

TERMS OF SERVICE AND USER AGREEMENT

Version 4.0 (October 15, 2008)

PLEASE READ THIS ENTIRE AGREEMENT AND INDICATE WHETHER YOU AGREE TO ITS TERMS BY CLICKING THE "ACCEPT" OR "DO NOT ACCEPT" BUTTON AT THE END OF THE AGREEMENT. YOUR ACCESS TO SONY COMPUTER ENTERTAINMENT AMERICA'S PLAYSTATION®NETWORK ("PSN") IS EXPRESSLY CONDITIONED UPON YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF YOU CLICK THE "DO NOT ACCEPT" BUTTON, YOU WILL NOT BE ABLE TO ACCESS PSN.

THIS AGREEMENT IS A CONTRACT BETWEEN YOU AND SONY COMPUTER ENTERTAINMENT AMERICA INC. ("SCEA") AND CAN BE ACCEPTED ONLY BY AN ADULT WHO IS OF LEGAL AGE OF MAJORITY IN THE COUNTRY IN WHICH YOUR PSN ACCOUNT IS REGISTERED. If you are under the legal age of majority, you must ask your parent or legal guardian to consent to this Agreement and Privacy Policy. By clicking the "ACCEPT" button yourself, you affirm that you have reached the legal age of majority and you accept this Agreement. You also affirm that you are accepting this Agreement on behalf of, and all legal and financial responsibility and liability for the actions of, your child and for all subordinate accounts ("Sub Accounts") attached to your Master Account and you hereby expressly ratify and confirm any acts of your child and all users of your Sub Accounts.

This Agreement applies to software, content and access to software and content provided through or in connection with PSN, including via the PlayStation®Store and virtual communities, whether delivered onto the PLAYSTATION®3 computer entertainment system, the PSP® (PlayStation®Portable) system, a personal computer or otherwise. Such access, software, and content include subscriptions, data, system software, fixes, updates or newer releases and related materials.

If you accept this Agreement, you are subject to its terms and all other agreements that you have entered into in connection with PSN. You agree that you will not directly or indirectly use PSN (i) in any way for any commercial purpose, (ii) in any way that violates the law or the community code of conduct, or (iii) in any way that harms or has the potential to harm SCEA, its parent company, or any affiliates, subsidiaries, licensors, providers, partners of SCEA or its parent company, and users. You agree that you will not use any unauthorized hardware or software to access or use PSN.

1. PSN ACCOUNT REGISTRATION

Through PSN, you may participate in SCEA's online community, play games online, and purchase access to content and services, such as new levels for your favorite games, movies, television shows or original programs such as Oore™. PSN may not be available, or may not be supported, in some countries and some languages. You must create a PSN account in order to access PSN's content and services. SCEA reserves the right to deny the creation of any account at its discretion and for any reason. Currently, there are no charges for creating a PSN account, but there may be charges associated with certain online content or services that are available through PSN. All information provided during PSN account registration must be truthful and accurate. There are two types of PSN accounts where available: Master Accounts and Sub Accounts. All PSN accounts must have an associated PSN mailbox for receiving text mail.

If you have reached the legal age of majority, you can create a Master Account for yourself. Where available, each Master Account can create up to six (6) associated Sub Accounts. You are not permitted to create Sub Accounts for persons under the legal age of majority who are not your children or for whom you are not the legal guardian. Your children must be of a certain age in order to have a Sub Account. Sub Accounts may not be available in all countries.

A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain chat features. Text mail from SCEA that relates to a Sub Account's purchases on PSN will be sent to the mailbox of the associated Master Account. At its sole discretion, SCEA may send text mail to the Master Account relating to the Sub Account's other activities on PSN. The Master Account holder is jointly and severally legally and financially responsible for the actions of his or her Sub Account holders on PSN.

Where available, a child under the legal age of majority can only have a Sub Account associated with a Master Account of the child's parent or legal guardian. If you are creating a Sub Account for a child, you must provide (i) your consent for SCEA to disclose, pursuant to SCEA's privacy policy, your child's personally identifying information to third parties for the purpose of allowing your child to participate in PSN activities, such as video and voice chat and gameplay; and (ii) your credit card information if requested by SCEA for Sub Accounts for children under the age of 13 in the United States and Canada or under the specific age applicable to your country. Your credit card will be used to verify parental consent under laws requiring such consent. You will not be charged a fee for creating the Sub Account. If you do not consent to the disclosure of this requested information, you will not be able to create a Sub Account for the child. If all requested information is provided, a separate email containing a code will be sent to the Master Account's email account with instructions to complete registration by entering the code into the Sub Account using a personal computer. You will need to create for your child an Online ID that will be associated with the child's PSN Sub Account. Please note that the Online ID is publicly available to and viewable by all PSN users and your child may receive text emails from any PSN users, including adults, in your child's PSN account mailbox. The parent's Master Account will not be notified of such text emails sent to a child's Sub Account mailbox. As the parent or legal guardian, it is your sole responsibility to monitor your child's access to or use of PSN, as well as any communications made or received by your child on or through PSN.

Some content may be objectionable or inappropriate to some users, including children under a certain age, which may vary from country to country. Please consider your child's age and check any content ratings and descriptions where available, before you access, download or purchase access to any items or permit your child to do so. In some cases, third parties provide ratings or descriptions for items, and SCEA therefore cannot guarantee the accuracy or completeness of such information. In addition, not all content is rated.

Some content that you download to your PLAYSTATION®3 computer entertainment system or PSP® (PlayStation®Portable) system may be accessible by all users of that system. Please monitor all access to content and communications that may be objectionable or age inappropriate. PSN parental controls will not apply to certain types of content such as content that is considered streamed material, user communication or certain categories of downloadable content. PSN parental controls may also not apply to some content that is not rated. Your child may not be able to access some content or play games rated for users older than his or her registered age. In some countries, parents and legal guardians with Master Accounts will be permitted to set their parental controls to override content restrictions on certain materials for associated Sub Accounts. Both Master Account and Sub Account holders select their own Online ID, Sign-In ID and password to gain access to their accounts. All users should safeguard their account information to prevent use by any other user. Certain information, which may include the Online ID, "About Me" statement, avatar pictures, country/area of residence, preferred language and recently played game titles, will be provided to all PSN users, including children. SCEA shall have no liability for any unauthorized usage of a PSN account. Deletion or termination of a Master Account will result in the deletion and termination of all associated Sub Accounts.

2. PSN COMMUNITY

Currently, no purchase is required to participate in general PSN community activities. If you have a PSN account, you may be able to chat via voice and video with friends and enjoy single sign on benefits without purchase, as well as enjoy online entertainment for which there is no subscription or purchase requirement.

3. COMMUNITY CODE OF CONDUCT

You must adhere to the following rules of conduct, and also follow a reasonable, common-sense code of conduct. Users are required to take into consideration community standards and refrain from abusive or deceptive conduct, cheating, hacking, or other misuse of PSN. Rights of other players should be respected.

The violations that are prohibited include but are not limited to the following:

You may not engage in deceptive or misleading practices.
You may not abuse or harass others, including but not limited to stalking behavior.
You may not take any action, or upload, post, stream, or otherwise transmit any content, language, images or sounds in any forum, communication, public profile, or other publicly viewable areas or in the creation of any Online ID that SCEA, in its sole discretion, finds offensive, hateful, or vulgar. This includes but is not limited to, any content or communication that SCEA in its sole discretion deems racially, ethnically, religiously, or sexually offensive, libelous, defaming, threatening, bullying or stalking.
You may not organize hate groups.
You may not upload, post, stream, or otherwise transmit any content that contains any viruses, worms, spyware, time bombs, or other computer programs that may damage, interfere with, or disrupt PSN.
You may not use, make, or distribute unauthorized software or hardware in conjunction with PSN, or take or use any data from PSN to design, develop or update unauthorized software or hardware, including but not limited to cheat code software or devices that circumvent any security features or limitations included on any software or devices.
You may not modify or attempt to modify the online client, disc, save file, server, client-server communication, or other parts of any game title, or content.
You may not cause disruption to any account, system, hardware, software, or network connected to PSN for any reason, including to gain an unfair advantage in a game.
You may not attempt to hack or reverse engineer any code or equipment in connection with PSN.
You may not provide anyone with your name or any other personally identifying information other than your own Online ID, or the name, password or personally identifying information of any other person or business through any means, including messaging, chat or any other form of PSN communication.
You may not take any action that SCEA considers to be disruptive to the normal flow of chat or gameplay, including without limitation, uploading, posting, streaming, or otherwise transmitting any unsolicited or unauthorized material, including junk mails, spams, excessive mails, or chain letters.
You may not introduce content that is commercial in nature such as advertisements, solicitations, promotions and links to web sites.
You may not introduce content that could be harmful to SCEA, its licensors, or players, such as any code or virus that may damage any property or interfere with the use of the property or PSN.
You may not upload, post, stream, access, or otherwise transmit any content that you know or should have known to be infringing, or that violates, any third party rights, any law or regulation, or contractual or fiduciary obligations.
You may not impersonate any person, including an SCEA or third party employee.
You may not provide SCEA or any third party company with false or inaccurate information, including reporting false complaints to SCEA Consumer Services or providing false or inaccurate information during account registration.
You may not sell, buy, trade, or otherwise transfer your Online ID or any personal access to PSN through any means or method, including by use of web auction sites.
You may not conduct any activities that violate any local, state or federal laws, including but not limited to, copyright or trademark infringement, defamation, invasion of privacy, identity theft, hacking, stalking, fraud, and the distribution of counterfeit software.

Unless otherwise required by applicable law, there is no requirement or expectation that SCEA will monitor or record any online activity on PSN, including communications. However, SCEA reserves the right to monitor and record any online activity and communication throughout PSN and you give SCEA your express consent to monitor and record your activities. SCEA reserves the right to remove any content and communication from PSN at SCEA's sole discretion without further notice to you. Any data collected in this way, including the content of your communications, the time and location of your activities, your Online ID and IP address and other related information may be used by us to enforce this Agreement or protect the interests of SCEA, its users, or licensors. Such information may be disclosed to the appropriate authorities or agencies. Any other use is subject to the terms of the applicable Privacy Policy. SCEA has no liability for any violation of this Agreement by you or by any other player.

4. ACCESS TO CONTENT ON PSN

PSN may provide you with the ability to buy access to a variety of content, including game-specific items, video content, as well as game and program subscriptions, where available. All content provided through PSN by SCEA, including content created or published by third parties. Third parties, including publishers may administer access to some content, including delivery, gameplay or customer service. To enable third parties to provide such access to you, we must provide them with your personal information. If you do not consent to allow us to share your personal information with third parties for the purpose of providing you with access to PSN content, you will not be able to participate in PSN. In order to access certain content, you may be required to accept additional content specific usage terms and conditions of SCEA or third party companies ("Usage Terms").Notwithstanding any provision of any other agreement, in the event of any conflict between this Agreement and the Usage Terms or any other terms and conditions in connection with PSN or any disc-based product used with PSN, this Agreement shall control.

In addition, you may be able to set your PLAYSTATION®3 computer entertainment system or other authorized device to automatically download or receive new content from the PlayStation®Store without further notice to you when you sign into PSN. Such content will be subject to the terms of this Agreement.

5. WALLET

All access to content may only be purchased from SCEA using funds from the PSN wallet, where available. All purchases made by the Sub Account or the Master Account must be made through a PSN wallet that is automatically associated with a Master Account. A Sub Account does not have its own separate wallet. Master Accounts can set a maximum spending amount for each Sub Account, effective at the beginning of the following month. A Master Account holder can fund the PSN wallet up to a maximum amount determined by SCEA ("Limit"), using either (i) a credit or debit card; (ii) a prepaid card or promotional code where available; or (iii) other payment methods approved by SCEA and made available from time to time in each specific country. SCEA reserves the right to refuse purchase of any wallet funds for any reason. Except as otherwise permitted by applicable law or as expressly provided in this Agreement, funds added to the wallet are non-refundable and non-transferable. Purchases of access to content are not refundable. Wallet funds have no value outside PSN and can only be used to purchase access to content from SCEA through PSN. Subject to applicable law, wallet funds that are deemed abandoned or unused by law will not be returned or restored.

6. PREPAID CARDS

Each Master Account and its associated Sub Accounts will be subject to the Limit. If you acquire a prepaid card that has a value that, when added to the wallet's existing balance, exceeds the Limit, you will not be able to apply the value of the prepaid card to the wallet until sufficient funds have been spent from the wallet to allow the sum of the full value of the prepaid card and wallet to be equal to or less than the Limit. Except as permitted by SCEA, the Master Account wallet will only accept prepaid cards with currency value from the same country as the one designated for the Master Account. SCEA is not responsible for, or liable for any claims arising as a result of the prepaid cards, including any problems encountered using a prepaid card or any defects in a prepaid card. Your use of the prepaid card in the United States and Canada is subject to terms and conditions at http://www.us.playstation.com/card. Additional terms and conditions may accompany the prepaid card.

7. PURCHASES AND TRANSACTIONS

All purchases and transactions on or through PSN, including transactions made through the PlayStation®Store, are purchases of content access solely between you and SCEA. By completing a transaction through your Master Account or allowing a transaction to take place through an associated Sub Account, you are (i) agreeing to pay for all purchases made by the Master Account and its associated Sub Accounts; (ii) authorizing SCEA to deduct from the wallet all applicable fees due and payable for all purchases made by the Master Account and its associated Sub Accounts; and (iii) agreeing to any applicable Usage Term and the terms and conditions associated with use of the particular content, subject to Section 4 above. To the extent permitted by applicable law, all sales are final upon the completion of your purchase, including purchase of rental content. To the extent permitted by applicable law, access to content is not refundable or transferable, and cannot be redeemed for cash, credit, or funds to your wallet. Prior to your purchase, you are encouraged to review description of the content you are acquiring and the content itself, where available (such as trailers and demos). SCEA reserves the right to deduct from the wallet any amount resulting from a Master Account holder's request to the Master Account holder's credit card company to reverse charges for a purchase on PSN. SCEA also reserves the right to terminate the Master Account and all Sub Accounts associated with the Master Account. In lieu of termination of the Master Account in such circumstances, SCEA may elect to provide a mechanism by which a Master Account may fund the wallet to prevent the Master Account and its associated Sub Accounts from being terminated. Except as otherwise provided on PSN, all transactions are made in the currency of your country of residence. Features, specifications, prices and content are subject to change or withdrawal at any time and SCEA does not provide any refunds in the event of a price drop or a subsequent promotional offering. Special product, prices and promotions displayed on PSN are no longer valid once they are changed or removed from PSN. Prices listed do not include sales tax. Applicable sales tax will be calculated and added at the time you purchase access to the specific content. In certain jurisdictions, local laws require that prices include all applicable taxes, in which case this will be indicated at the time of purchase. To the extent permitted by applicable law, all sales are subject to the laws of the State of California, County of San Mateo.

You may be able to make purchases only from a designated Sony regional company which is determined by your country/area of residence. Your country/area of residence may be verified by your credit or debit card number and may be rejected if the information does not match. If you are a Master Account holder, you will receive an email summary for each purchase after it is made, if you have given us a valid, current, operational email address. You can view your purchase history in the PSN Account Management area.

Although SCEA will try to ensure that all prices, product descriptions, and its associated terms and conditions are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you promptly. You will have the option of either reconfirming your order at the correct price or canceling it. If we are unable to contact you, your order will be cancelled.

Upon SCEA's confirmation, access to content will be made available to you through your PSN account. You bear all risk of loss for completing the download of any content and for any loss of content you have downloaded, including any loss due to a file corruption or hard drive crash.You are solely responsible for the storage and safekeeping of your content. SCEA is not responsible for providing you with replacement copies for any reason.

From time to time, SCEA may issue promotional codes or "promo codes" which can be used to access promotional offers for PSN content or services. Each promo code will be subject to specific terms and conditions which will be communicated to you in connection with the promotion. Promo codes may not be available in all countries or to all users, and age restrictions may apply. Promo codes must be used before the specified expiration date, and in accordance with applicable terms and conditions. Unless otherwise stated, promo codes may be used once only by the recipient and may not be transferred or sold to any other person.

8. GENERAL LICENSE RESTRICTIONS AND TERMS

Except as stated in this Agreement, all content and software provided through PSN are licensed non-exclusively and revocably to you, your children and children for whom you are a legal guardian (collectively for purposes of this section, "You" or "Your"), solely for Your personal, private, non-transferable, non-commercial, limited use on a limited number of activated PLAYSTATION®3 computer entertainment systems, PSP® (PlayStation®Portable) systems, and any other hardware devices authorized by SCEA in the country in which your PSN account is registered. All intellectual property rights subsisting in PSN, including but not limited to, all software, data, and content subsisting in or connection with the operation of PSN, the Online ID, the access to content offered on or through PSN and hardware used in connection with PSN (collectively defined as "Property"), belong to SCEA and its licensors. All use or access to such Property shall be subject to the terms of this Agreement and all applicable copyright and other intellectual property rights laws. You may not sell, rent, sublicense, modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Property. Except as stated in this Agreement or otherwise expressly permitted by SCEA in writing, you may not reproduce or transfer any portion of the Property. You may not create any derivative works, attempt to create the source code from the object code, or download or use any Property for any purpose other than as expressly permitted. You may not bypass, disable, or circumvent any encryption, security, digital rights management or authentication mechanism in connection with PSN or any of the content offered through PSN. You acknowledge that the PSN, including some content provided through PSN, may contain security or technical features that will prevent use of such content in violation of this Agreement. Notwithstanding any terms, the Property is not licensed for resale, public performance, display, distribution or broadcast. You acknowledge that some content providers and licensors are intended third party beneficiaries who have rights to enforce this Agreement against you and your permitted users. Except as expressly granted in this Agreement, SCEA and its licensors reserve all rights, interests, and remedies in connection with PSN and the Property.

Additional terms of use may apply to particular content. Use or license terms may be more restrictive depending on content. Please read carefully all specific terms of use for particular content or service before purchasing. The restrictions to which particular content or service is subject are in the sole discretion of SCEA or its licensors and are subject to change at any time. Use of the terms "purchase," "sale," "sold," "sell" or "buy" on PSN or in connection with PSN shall not mean or imply any transfer of ownership of any content, data or software or any intellectual property rights therein from SCEA or its licensors to any user or third party. All other company, product, and service names and logos referenced on PSN are the marks, trade names, trademarks/service marks, and registered trademarks/service marks ("Marks") of their respective owners. You may not use or reproduce any Marks without the owner's express written consent. You may not remove any proprietary notices or labels from any content.

9. VIDEO CONTENT

Subject to the terms of this Agreement and any additional terms and conditions for the particular content, SCEA licenses digitalized content of programs, including television shows and movies ("Video Content") to you for your personal, private, non-commercial viewing in the United States only on a limited number of activated PLAYSTATION®3 computer entertainment systems and PSP® (PlayStation®Portable) system(s) ("Authorized Device") during the authorized viewing period ("Authorized Term"). Video Content may be made available to you as a rental or purchase. You may rent the content for a limited duration ("Rental Content"), or enjoy the content continuously subject to certain digital rights management rules and the terms and conditions of this Agreement ("Sold Content"). Except for rights explicitly granted to you, all rights in the Video Content are reserved by SCEA and its third party licensors.

Only one copy of Rental Content may be viewable on an Authorized Device for up to 24 hours after the first playback or 14 days after payment for the Rental Content, whichever is sooner. After such time, you will not be able to view the Rental Content. Rental Content may not be reproduced. However, Rental Content in standard definition format that was originally downloaded onto a PLAYSTATION®3 computer entertainment system may be transferred once by the PSN account that purchased the content to one activated PSP® (PlayStation®Portable) system during the Authorized Term. Thereafter, the Rental Content will not be available on the original PLAYSTATION®3 computer entertainment system, and no subsequent transfer to any other device including a PLAYSTATION®3 computer entertainment system or a PSP® (PlayStation®Portable) system is currently permitted. Rental Content in standard definition format that was originally downloaded onto a PSP® (PlayStation®Portable) system may be viewable on only one (1) activated PSP® (PlayStation®Portable) system during the Authorized Term. Rental Content in high definition format may be viewed on only one (1) activated PLAYSTATION®3 computer entertainment system.

You may view Sold Content for an unlimited number of times on an Authorized Device. Sold Content in standard definition format that was initially downloaded onto a PLAYSTATION®3 computer entertainment system may be copied solely by the PSN account that purchased the Sold Content for use on up to three (3) activated PSP® (PlayStation®Portable) systems. Sold Content in standard definition format that was initially downloaded for a PSP® (PlayStation®Portable) system may be viewable on two (2) other activated PSP® (PlayStation®Portable) systems. Sold Content in high definition format may be viewed on only one (1) activated PLAYSTATION®3 computer entertainment system.

Proper activation of the PLAYSTATION®3 computer entertainment system or the PSP® (PlayStation®Portable) system by the PSN account that purchased the Video Content is required for all downloads, transfers, copies and viewings. Purchase of Video Content is connected to the purchasing PSN account and any one PSN account can activate no more than the maximum number of Authorized Devices stated in this Agreement or in any terms and conditions for the particular Video Content, regardless of the number of copies of Video Content purchased using the PSN account. Video Content may not be transferred from one PSN account to another. SCEA reserves the right to limit the number of times the PLAYSTATION®3 computer entertainment system or the PSP® (PlayStation®Portable) system may be activated or deactivated.

Downloading will be not permitted outside the Authorized Term. In addition, once the Video Content has been downloaded from PSN, you will not be able to download it again for any reason without purchase of another copy.

Some content such as movie trailers may not be representative of the actual feature presentation. Digitalized versions of some content may not be identical with the original formatted content or previously released versions of the same titled content.

Video Content will play on displays ranging from standard definition to 1080p depending on the content. Video output in certain formats may require additional equipment, sold separately.

10. SUBSCRIPTIONS

Subscriptions may not be shared among any PSN accounts, including the Master Account with its associated Sub Accounts. All subscriptions will be automatically renewed unless you cancel the subscription. For automatic renewal, your wallet must contain funds in an amount sufficient to cover the subscription's automatic renewal cost, or your subscription will be terminated. If you do not have sufficient funds in your wallet and you have previously entered your credit card billing information, your credit card will be automatically charged a minimum amount determined by SCEA in order to renew your subscription automatically, even if the amount charged exceeds the cost of the subscription. Any difference between the amount charged and the sum of the cost of the subscription and existing balance will be credited to your wallet. Subscription charges may be increased at the end of each subscription period. If charges are increased, you will be asked to confirm whether to continue with the subscription. You may cancel subscriptions via PSN Account Management. Cancellation will take effect from the next renewal of that subscription. Except as otherwise stated in this Agreement, you will not receive a refund for any subscriptions paid in advance.

11. MAINTENANCE AND UPGRADES

From time to time, it may become necessary for SCEA to provide certain content to you to ensure that PSN and content offered through PSN, your PLAYSTATION®3 computer entertainment system, the PSP® (PlayStation®Portable) system or other SCEA-authorized hardware is functioning properly in accordance with SCEA guidelines. Some content may be provided automatically without notice when you sign into PSN. Such content may include automatic updates or upgrades which may change your current operating system, cause a loss of data or content or cause a loss of functionalities or utilities. Such upgrades or updates may be provided for system software for your PLAYSTATION®3 computer entertainment system, the PSP® (PlayStation®Portable) system, or other SCEA-authorized hardware. Access or use to any system software is subject to terms and conditions of a separate end user license agreement found at http://www.us.playstation.com/termsofuse. You authorize SCEA to provide such content and agree that SCEA shall not be liable for any damages arising from provision of such content or maintenance services. It is recommended that you regularly back up any data located on the hard disk that is of a type that can be backed up.

12. USER MATERIAL AND INFORMATION

SCEA may provide others, including but not limited to its subsidiaries or affiliates, with information relating to your participation on PSN, including your communication and game play provided through PSN ("Information"). You hereby authorize SCEA to use, distribute, copy, display, and publish your Information for any legitimate business purpose, including tournaments and ranking, without payment to you. In addition, you will have the option to post, stream or transmit content such as pictures, photographs, game related materials, or other information through PSN to share with others ("User Material"), provided no rights of others are violated. To the extent permitted by law, You authorize and license SCEA a royalty free and perpetual right to use, distribute, copy, modify, display, and publish your User Material for any reason without any restrictions or payments to you or any third parties. You further agree that SCEA may sublicense its rights to any third party, including its affiliates and subsidiaries. You hereby waive all claims, including any moral rights, against SCEA, its affiliates and subsidiaries for SCEA or any other third party's use of User Material to the extent permitted by applicable law. By posting, streaming, or transmitting any User Material, you represent and warrant that you have the appropriate rights to use, post, distribute, and transmit the User Material and to grant SCEA the foregoing license. You further agree to cooperate with SCEA in resolving any dispute that may arise from your Information or User Material. SCEA reserves the right to remove any Information or User Material at its sole discretion.

Some games played on or provided through PSN may have features that allow your information, including game play, PSN ID, Friend's list, messages and related gaming information to be recorded by a user and distributed to any third party publicly, including users outside of PSN. You agree that any third party may record, use and distribute such information for any reason without any restrictions or compensation to you. Additional terms and conditions may apply, including SCEA's privacy policy and the terms and conditions of any game publisher or service provider. Please review all terms carefully. If you do not want your information to be used, recorded or distributed, please do not play the game online through PSN.

Through your use of PSN, you may be provided with information about SCEA's or a third party's products or services. This information includes, but is not limited to, promotions, advertisements, product placements or marketing materials within PSN or a game, irrespective of whether the game is connected with or provided through PSN. You agree that SCEA and its partners and providers may collect information regarding your activities, access, or game play, and may use and distribute such information subject to the terms of SCEA's privacy policy or the policies of third parties where applicable. SCEA does not endorse any of the third party products or services advertised, promoted or marketed.

13. TERMINATION/ CANCELLATION

If SCEA determines in its sole discretion that you have violated any term of this Agreement, the Usage Terms, or any other terms and conditions connected with PSN or have otherwise injured or damaged the PSN community, SCEA may take all actions to protect its interests, including termination or suspension of your PSN account (both the Master Account and any associated Sub Accounts), automatic removal or blockage of the content, implementation of upgrades or devices intended to discontinue unauthorized use, or reliance on any other remedial efforts as necessary to remedy the violation. If your breach is in connection with content that you have downloaded, you must immediately cease use of such content and delete all copies from all of your devices. Upon termination for any reason, you will not receive a refund for items, value accumulated on in-game items or any unused balance in your wallet except as expressly provided in this Agreement and to the extent permitted by applicable law. Any game ranking or scores, or information in connection with PSN will not be retained or accessible by you or your associated Sub Accounts. SCEA reserves the right to bring legal action and to participate in any government or private legal action or investigation relating to your conduct, which may require the disclosure of your information. Unless as otherwise stated in this Agreement, SCEA, at its sole discretion, may indefinitely suspend, or discontinue any and all online access to content at any time, including for maintenance service or upgrades, without prior notice or liability.

14. GENERAL LEGAL

SCEA, at its sole discretion, may modify the terms of this Agreement at any time, including imposing a fee for creating PSN accounts. By accepting this Agreement or by accessing PSN, you agree to be bound by all current terms of the Agreement. To access a printable, current copy of this Agreement, go to http://www.us.playstation.com/termsofuse on your personal computer. If material changes to this Agreement are made, you will be notified by a posting as you sign in to PSN. If necessary, you will be given additional choices regarding such change(s). Your continued use of PSN, including use of your associated Sub Account(s), will signify your acceptance of these changes. If you do not accept material changes to the Agreement, then you may contact us to terminate this Agreement and your account(s). If there are funds in your wallet as of the date SCEA terminates your account, those funds may be refunded to you and you will not be able to access PSN.

If any provision of this Agreement is held illegal or otherwise unenforceable by a court of competent jurisdiction, that provision shall be severed and the remainder of the Agreement shall remain in full force and effect.

Except as otherwise required by applicable law, this Agreement shall be construed and interpreted in accordance with the laws of the State of California applying to contracts fully executed and performed within the State of California. Except as otherwise required by applicable law, both parties submit to personal jurisdiction in California and further agree that any dispute arising from or relating to this Agreement shall be brought in a court within San Mateo County, California. In the event of litigation to enforce any part of this Agreement, all costs and fees, including attorney's fees, shall be paid by the non-prevailing party to the extent permitted by applicable law.

15. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

No warranty is given about the quality, functionality, availability or performance of PSN, or any content offered on or through PSN. In addition to the limitations of liability in Sections 1, 3, 11 and 13 of this Agreement, SCEA expressly disclaims any implied warranty of merchantability, warranty of fitness for a particular purpose and warranty of non-infringement. SCEA assumes no liability for any inability to purchase access to or use any content. YOUR SOLE AND EXCLUSIVE RECOURSE IN THE EVENT OF ANY DISSATISFACTION WITH OR DAMAGE ARISING FROM PSN OR IN CONNECTION WITH THIS AGREEMENT AND SCEA'S MAXIMUM LIABILITY UNDER THIS AGREEMENT OR WITH RESPECT TO YOUR USE OF OR ACCESS TO PSN SHALL BE LIMITED TO YOUR DIRECT DAMAGES, NOT TO EXCEED THE UNUSED FUNDS IN YOUR WALLET AS OF THE DATE OF TERMINATION. EXCEPT AS STATED IN THE FOREGOING SENTENCE, SCEA EXCLUDES ALL LIABILITY FOR ANY LOSS OF DATA, DAMAGE CAUSED TO YOUR SOFTWARE OR HARDWARE, AND ANY OTHER LOSS OR DAMAGE SUFFERED BY YOU OR ANY THIRD PARTY, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL AND HOWEVER ARISING, AS A RESULT OF ACCESSING OR DOWNLOADING ANY CONTENT TO YOUR PLAYSTATION®3 COMPUTER ENTERTAINMENT SYSTEM, THE PSP® (PLAYSTATION®PORTABLE) SYSTEM, OR ANY HARDWARE DEVICE, OR USING OR ACCESSING PSN. UNLESS THIS PROVISION IS UNENFORCEABLE IN YOUR JURISDICTION, THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE. Internet Service Provider fees are the full responsibility of the user.

1. ENREGISTREMENT D'UN COMPTE PSN

Par l'intermédiaire de PSN, vous pouvez participer à la communauté en ligne de SCEA, jouer aux jeux en ligne et acheter du contenu et des services, notamment de nouveaux niveaux pour vos jeux favoris, des films, des émissions télévisées ou encore des programmes originaux tels que Qore™. Il se peut que PSN ne soit pas disponible ou ne puisse pas être pris en charge dans certains pays ou dans certaines langues. Vous devez créer un compte PSN afin d'accéder aux contenus et services de PSN. SCEA se réserve le droit, à son entière discrétion et pour quelque raison que ce soit, d'interdire la création d'un compte. Actuellement, la création d'un compte PSN n'entraîne aucune facturation, mais des frais peuvent être facturés pour certains contenus ou services disponibles par le biais de PSN. Toutes les informations fournies lors de l'enregistrement du compte PSN doivent être sincères et exactes. Si applicable, il existe deux types de comptes PSN : les Comptes principaux et les Comptes secondaires. Le titulaire d'un Compte principal est, d'un point de vue juridique et financier, conjointement et solidairement responsable de toutes les actions des titulaires de ses Comptes secondaires associés sur PSN.

Si applicable, toute personne mineure ne peut posséder qu'un Compte secondaire associé à un Compte principal créé par l'un de ses parents ou par son tuteur légal. Lorsque vous créez un Compte secondaire pour un enfant âgé de moins de 13 ans, vous devez (i) donner votre accord à SCEA sur la communication des informations d'identification personnelle de votre enfant à des tiers, et ce, conformément à la Charte de confidentialité de SCEA, afin de permettre à votre enfant de participer à des activités sur PSN, comme le chat audio et vidéo en ligne et les jeux, et (ii) fournir les informations relatives à votre carte bancaire sur demande de SCEA pour les comptes secondaires des enfants de moins de 13 ans résidants aux États-Unis ou au Canada, ou n'ayant pas atteint l'âge de la majorité dans votre pays. Si vous refusez de donner votre accord pour la communication des informations demandées, vous ne pourrez pas créer de Compte secondaire pour votre enfant. Lorsque toutes les informations demandées sont fournies, un e-mail est envoyé à la messagerie électronique du Compte principal avec un code et les instructions permettant de terminer l'inscription en saisissant le code dans le Compte secondaire via un ordinateur personnel. Vous devez créer l'ID en ligne de votre enfant qui sera associé à ce Compte PSN secondaire dont il sera le titulaire. Les titulaires de Comptes principaux et secondaires choisissent leur propre ID en ligne, leur ID de connexion et leur mot de passe pour obtenir l'accès à leurs comptes. Tous les utilisateurs doivent préserver les informations de leur compte afin d'empêcher leur usage par tout autre utilisateur. Certaines informations, qui peuvent inclure l'ID en ligne, la déclaration "À propos de moi", les avatars, le pays/la région de résidence, la langue préférée et les titres de jeux récemment joués, seront mis à disposition de tous les utilisateurs PSN, dont les enfants. SCEA ne peut être tenu responsable de l'usage non autorisé d'un compte PSN. La suppression ou la résiliation d'un Compte principal entraînera la suppression et la résiliation de tous les Comptes secondaires associés.

2. COMMUNAUTÉ PSN

Actuellement, aucun achat n'est nécessaire pour participer aux activités générales de la communauté PSN. Lorsque vous possédez un compte PSN, vous pouvez avoir la possibilité de chatter en ligne avec des amis (en mode audio ou vidéo) et de profiter des avantages uniques de votre connexion, ainsi que des loisirs en ligne pour lesquels aucun abonnement ou achat n'est requis.

3. CODE DE CONDUITE DE LA COMMUNAUTÉ

Vous devez accepter les règles de conduite suivantes et respecter également un code de conduite élémentaire et raisonnable. Les utilisateurs sont tenus de respecter les principes de la communauté et de s'interdire toute conduite abusive ou trompeuse, la tricherie, le piratage ou toute autre utilisation abusive de PSN. Les droits des autres joueurs doivent être respectés.

Les violations visées sont notamment les suivantes :

Il vous est interdit de vous livrer à des pratiques trompeuses ou fallacieuses ;
Il vous est interdit d'insulter ou de tourmenter quiconque et notamment de recourir au harcèlement ;
Il vous est interdit de prendre des actions ou télécharger, publier, diffuser en flux ou transmettre autrement, dans un forum, une communication, un profil public ou toute autre zone visible publiquement ou lors de la création d'une ID en ligne, un contenu, un langage, une image ou un son que SCEA juge, sa seule discrétion, insultant, haineux ou vulgaire. Ceci inclut notamment tout contenu ou communication que SCEA déclare, à sa seule discrétion, racialement, ethniquement, religieusement ou sexuellement insultant, diffamatoire, menaçant, intimidant ou harcelant.
Il vous est interdit d'organiser des groupes haineux.
Il vous est interdit de télécharger, publier, diffuser en flux ou transmettre autrement un contenu contenant des virus, des vers, des logiciels espions, des bombes à retardement ou tous autres programmes informatiques susceptibles d'endommager ou de perturber PSN ou d'interférer avec PSN.
Il vous est interdit d'utiliser, de reproduire ou de distribuer des logiciels ou du matériel non autorisé conjointement avec PSN ou de prendre ou d'utiliser toute donnée depuis PSN pour concevoir, développer ou mettre à jour des logiciels ou du matériel non autorisés et notamment la fraude relative aux codes de périphériques ou de logiciels permettant de contourner tout dispositif ou restrictions de sécurité comprises dans tout logiciel ou périphérique ;
Il vous est interdit de modifier ou de tenter de modifier le client en ligne, le disque, le fichier de sauvegarde, le serveur, la communication client-serveur ou toute autre partie d'un jeu ou contenu ;
Il vous est interdit de provoquer des perturbations pour tout compte, système, matériel, logiciel ou réseau connecté à PSN, pour quelque raison que ce soit, notamment afin de tirer un avantage de façon déloyale dans un jeu ;
Il vous est interdit d'essayer de pirater ou de rétro-compiler tout code ou équipement dans le cadre de PSN ;
Il vous est interdit de communiquer à quiconque votre nom ou toute autre information d'identification personnelle, autre que votre propre ID en ligne, ou le nom, le mot de passe ou les informations d'identification personnelle de toute autre personne ou entreprise par tout biais, y compris par messagerie, par chat ou toute autre forme de communication sur PSN ;
Il vous est interdit d'entreprendre des actions qui, selon SCEA, perturbent le flux normal des discussions ou des parties, notamment le téléchargement, la publication, la diffusion en flux ou toute autre transmission d'éléments non sollicités ou non autorisés, y compris les pourriels, les messages non sollicités, les messages envoyés en quantité excessive ou les lettres en chaîne ;
Il vous est interdit d'insérer du contenu à teneur commerciale, comme des publicités, des sollicitations, des promotions ainsi que des liens vers d'autres sites Internet ;
Il vous est interdit d'insérer un contenu qui pourrait s'avérer préjudiciable à SCEA, à ses concédants de licence ou joueurs comme tout code ou virus qui pourrait endommager un bien ou interférer dans l'utilisation de ce bien ou de PSN ;
Il vous est interdit de télécharger en amont, de publier, de diffuser en flux, d'accéder ou d'utiliser toute autre méthode de transmission pour laquelle vous savez ou devriez savoir qu'elle enfreint ou viole les droits d'un tiers, une loi ou réglementation ou des obligations contractuelles ou fiduciaires.
Il vous est interdit d'usurper l'identité d'une personne quelle qu'elle soit, notamment un employé de SCEA ou d'un tiers.
Il vous est interdit de fournir à SCEA ou à toute société tierce des informations fausses ou inexactes, notamment de signaler des fausses réclamations au Service clientèle de SCEA ou de fournir des informations fausses ou inexactes lors de l'enregistrement du compte ;
Il vous est interdit de vendre, acheter, échanger ou transférer de quelque manière votre ID en ligne ou tout autre accès personnel à PSN par tout moyen ou méthode, notamment par le biais de l'utilisation de sites Internet de mise aux enchères ;
Il vous est interdit de mener des activités qui constitueraient une violation d'une loi locale, nationale ou fédérale, notamment mais sans limitation, la violation d'un droit d'auteur, la contrefaçon d'une marque commerciale, la diffamation, la violation de la vie privée, l'usurpation d'identité, le piratage, le harcèlement, la fraude et la distribution de logiciels de contrefaçon.

Sauf disposition contraire requise par le droit applicable, il n'est ni requis ni prévu que SCEA surveille et enregistre les activités en ligne sur PSN, notamment les communications. Cependant, SCEA se réserve le droit de contrôler et d'enregistrer toute activité en ligne et communications sur PSN et vous acceptez de donner votre accord exprès à SCEA pour surveiller et enregistrer vos activités. SCEA se réserve le droit, à son entière discrétion et sans préavis, de supprimer tout contenu ou toute communication dans toute partie du PSN. Toutes les données ainsi recueillies, y compris le contenu de vos communications, l'heure et le lieu de vos activités, votre ID en ligne et adresse IP, ainsi que d'autres renseignements connexes peuvent être utilisés par nous-mêmes pour faire valoir cet Accord ou pour protéger les intérêts de SCEA, de ses utilisateurs ou de ses concédants de licence. Ces informations peuvent êtres divulguées aux autorités ou organismes publics appropriés.
Toute autre utilisation est sujette aux termes de la Charte de confidentialité appropriée.
SCEA ne peut être tenu responsable des violations du présent Accord de votre fait ou du fait d'un autre joueur.

4. ACCÈS AU CONTENU DE PSN

PSN peut vous offrir la possibilité d'acheter un accès à une variété de contenus, y compris des articles particuliers à certains jeux, du contenu vidéo, ainsi que des abonnements à des jeux ou à des programmes, si applicable. Tous les contenus fournis par l'intermédiaire de PSN, le sont par SCEA, notamment les contenus créés ou publiés par des tiers. Il se peut que des tiers, notamment les éditeurs, administrent l'accès à certains contenus, y compris la livraison, le jeu ou le service à la clientèle. Afin de permettre à ces tiers de vous fournir cet accès, nous devons leur fournir vos informations personnelles. Si vous refusez de nous autoriser à partager vos informations personnelles avec des tiers afin de vous fournir l'accès au contenu PSN, vous ne pourrez pas participer à des activités sur PSN. Afin d'accéder à certains contenus, il peut vous être demandé d'accepter des conditions d'utilisation supplémentaires spécifiques à certains contenus et provenant de SCEA ou de tierces parties ("Contrat de service").Nonobstant toute disposition contraire stipulée dans tout autre contrat et dans l'éventualité d'un conflit entre les modalités du présent Accord et celles du Contrat de service ou d'autres termes et conditions d'utilisation liés au PSN ou dans le cadre de tout produit sur disque utilisé par le biais de PSN, le présent Accord primera.

En outre, il se peut que vous ayez configuré votre système de loisir interactif PLAYSTATION®3 ou tout autre dispositif autorisé, de sorte qu'il télécharge ou reçoive automatiquement de nouveaux contenus de PlayStation®Store, sans qu'aucun autre avis ne sous soit adressé lorsque vous vous connectez à PSN. Ces contenus seront soumis aux conditions du présent Accord.

5. PORTEFEUILLE

Tout l'accès au contenu et aux services peut être acheté uniquement auprès de SCEA en utilisant les fonds du portefeuille PSN, si applicable. Tous les achats effectués depuis des Comptes secondaires ou des Comptes principaux doivent être réglés par le biais du portefeuille PSN qui est automatiquement associé à votre Compte principal. Un Compte secondaire ne possède pas de portefeuille distinct. Les Comptes principaux peuvent fixer, pour chaque Compte secondaire, un plafond maximum de dépenses, entrant en vigueur au début du mois suivant. Le titulaire d'un Compte principal a la possibilité d'alimenter son portefeuille PSN, jusqu'à un plafond maximum fixé par SCEA ("Limite"), (i) en utilisant une carte bancaire, (ii) par l'achat de cartes prépayées en ligne ou de codes promotionnels, ou (iii) par d'autres méthodes de paiement autorisées par SCEA et disponibles de temps à autre dans chaque pays particulier. SCEA se réserve le droit, pour quelque raison que ce soit, de refuser l'achat de fonds crédités à tout portefeuille. Sauf autorisation stipulée par la loi applicable ou comme expressément stipulé dans le présent Accord, les fonds ajoutés au portefeuille ne sont ni remboursables ni transférables. Les achats d'accès au contenu ne sont pas remboursables. Les fonds crédités au portefeuille n'ont aucune valeur en dehors de PSN et ne peuvent être utilisés que pour l'achat d'accès au contenu auprès de SCEA par l'intermédiaire de PSN. Sous réserve de la loi applicable, les fonds crédités au portefeuille qui sont déclarés abandonnés ou inutilisés par la loi ne seront ni restitués ni reconstitués.

6. CARTES PRÉPAYÉES

Le Compte principal et son Compte secondaire associé seront assujettis à la Limite susmentionnée. Lorsque vous faites l'acquisition d'une carte prépayée dont le montant ajouté au solde actuel du portefeuille dépasse la Limite, vous ne serez pas en mesure de créditer la valeur de la carte prépayée au portefeuille tant que les fonds crédités au portefeuille n'auront pas été dépensés pour permettre à la somme totale des valeurs de la carte prépayée et du portefeuille d'être égale ou inférieure à la Limite. Sauf autorisation particulière provenant de SCEA, le Compte principal acceptera uniquement les cartes prépayées dont la valeur de la devise correspond à la devise du pays désigné par le Compte principal. SCEA ne sera pas tenu pour responsable ou redevable des réclamations liés aux cartes prépayées, y compris les problèmes liés à l'utilisation d'une carte prépayée ou des défauts d'une carte prépayée. L'utilisation d'une carte prépayée aux États-Unis et au Mexique est soumise aux modalités et conditions visibles à l'adresse http://us.playstation.com/. Des termes et conditions supplémentaires peuvent accompagner les différentes cartes prépayées disponibles.

7. ACHATS ET TRANSACTIONS

Tous les achats et transactions sur ou via PSN, y compris les transactions passées par l'intermédiaire de PlayStation®Store, sont des achats d'accès au contenu exclusivement entre vous et SCEA. En effectuant une transaction par le biais de votre Compte principal ou en permettant une transaction par le biais d'un Compte secondaire associé, vous acceptez (i) de régler tous les achats effectués par le Compte principal et ses Comptes secondaires associés, (ii) d'autoriser SCEA de déduire du portefeuille tous les frais applicables à tous les achats effectués par le Compte principal et ses Comptes secondaires associés, et (iii) de vous conformer à toute modalité d'un Contrat de service applicable ainsi qu'aux termes et conditions d'utilisation associées au contenu spécifique, sous réserve de la Section 4 mentionnée ci-dessus. Dans les limites permises par la législation en vigueur, toutes les ventes sont définitives au moment de l'achèvement de votre achat, y compris l'achat d'un contenu en location. Dans les limites permises par la législation en vigueur, l'accès au contenu n'est pas remboursable ou transférable, et ne peut être remboursé ni en espèces ni sous forme d'avoirs, et ne sera pas crédité à votre portefeuille. Avant d'effectuer votre achat, nous vous encourageons de vérifier, si disponible, le contenu que vous achetez et sa description (notamment les bandes-annonces et les démos). SCEA se réserve le droit d'imputer au portefeuille tout montant résultant d'une demande du titulaire du Compte principal à la société de la carte bancaire du titulaire du Compte principal pour virer les frais lors d'un achat sur PSN. En outre, SCEA se réserve le droit de résilier le Compte principal et tous les Comptes secondaires associés au Compte principal. À défaut de résilier le Compte principal en de telles circonstances, SCEA peut décider de proposer une procédure par laquelle un Compte principal aura la possibilité d'alimenter le portefeuille afin de prévenir la résiliation du Compte principal et de ses Comptes secondaires associés. Sauf disposition contraire stipulée sur PSN, toutes les transactions sont effectuées dans la devise de votre pays de résidence. Les fonctionnalités, caractéristiques, prix et le contenu peuvent, à tout moment, faire l'objet d'une modification ou d'un retrait et SCEA ne prévoit pas d'effectuer de remboursements en cas de baisse des prix ou d'offre promotionnelle future. Les produits spéciaux, les prix et les promotions affichés sur PSN ne sont plus valables dès lors qu'ils ont été modifiés ou retirés de PSN. Les prix affichés s'entendent hors taxes. Les taxes sur les ventes applicables seront calculées et ajoutées lors de votre achat d'accès à un contenu particulier. Dans certaines juridictions, la réglementation locale impose que les prix affichés incluent toutes les taxes applicables et que dans ce cas elles soient visibles au moment de l'achat. Dans la mesure permise par la loi applicable, toutes les ventes sont soumises aux lois de l'État de Californie, Comté de San Mateo.

Il se peut que les achats ne soient possibles qu'auprès de la société régionale SCEA désignée dans votre pays/région de résidence. Il se peut que votre pays/région de résidence soit vérifié(e) par comparaison avec le numéro de votre carte bancaire et il se peut que votre achat soit rejeté si les informations ne concordent pas. Si vous êtes le titulaire du Compte principal, vous recevrez par e-mail un récapitulatif pour chaque achat effectué, si vous nous avez communiqué une adresse électronique valide, actuelle et opérationnelle. Vous pouvez visualiser l'historique de vos achats dans la section Gestion du compte PSN.

Bien que SCEA s'efforce de garantir l'exactitude des prix, des descriptions de produit et des termes et conditions d'utilisation associés, des erreurs peuvent se produire. Si nous relevons une erreur dans le prix des éléments que vous avez commandés, nous vous contacterons aussitôt que possible. Vous aurez la possibilité de confirmer votre commande au prix rectifié ou de l'annuler. Si nous sommes dans l'impossibilité de vous contacter, votre commande sera annulée.

Suivant confirmation de SCEA, l'accès au contenu vous sera remis par l'intermédiaire de votre compte PSN. Vous êtes seul responsable des pertes subies suivant un téléchargement de contenu, y compris les pertes provenant de fichiers endommagés ou de pannes de disque dur. Vous êtes également entièrement responsable du stockage et de la protection appropriés de votre contenu. SCEA ne s'engage aucunement à vous fournir des copies de remplacement pour n'importe quelle raison.

Il se peut que, de temps à autre, SCEA émette des codes promotionnels ou « promo codes » qui peuvent être utilisés pour accéder aux offres promotionnelles de contenus ou services PSN. Chaque promo code sera soumis à des conditions et modalités spécifiques qui vous seront communiquées dans le cadre de la promotion. Il se peut que ces codes promotionnels ne soient pas disponibles dans tous les pays ou pour tous les utilisateurs et que des restrictions d'âge s'appliquent. Les codes promotionnels doivent être utilisés, avant la date d'expiration spécifiée, conformément aux conditions et modalités applicables. Sauf disposition contraire, les codes promotionnels ne peuvent être utilisés qu'une seule fois par le destinataire et ne peuvent ni transférés ni vendus à une autre personne.

8. RESTRICTIONS ET CONDITIONS DE LICENCE GÉNÉRALES

Sauf comme stipulé dans cet Accord, tous les contenus et logiciels fournis par l'intermédiaire de PSN sont concédés sous licence non exclusive et révocable, à vous-même, à vos enfants ou aux enfants dont vous êtes le tuteur légal (collectivement appelés au sens de cette section "Vous" ou "Votre"), que pour Votre usage personnel, privé, non transférable, non commercial et pour une utilisation limitée sur un nombre limité de systèmes informatiques de loisir interactif activés PLAYSTATION®3 et de systèmes PSP® (PlayStation®Portable), ou sur tous autre matériel autorisé par SCEA dans le pays d'enregistrement de votre compte PSN. Tous les droits de propriété intellectuelle présents dans PSN, y compris mais sans s'y limiter, les logiciels, les données et les contenus actuels fournis sur PSN ou dans le cadre de l'utilisation de PSN, l'accès au contenu offerts sur PSN ou par le biais de PSN ainsi que ID en ligne, les matériels utilisés dans le cadre de PSN (collectivement appelés "Bien"), appartiennent à SCEA et à ses concédants de licence. Toute utilisation de ce Bien ou tout accès à ce Bien sera soumis aux conditions du présent Accord ainsi qu'aux lois applicables en matière de droits d'auteurs et autres droits de propriété intellectuelle. Vous n'êtes pas autorisé à vendre, transférer, louer, concéder des sous-licences, modifier, adapter, traduire, rétro-compiler, décompiler ou désassembler toute partie du Bien. Sauf comme stipulé dans le présent Accord ou autrement expressément autorisé par écrit par SCEA, il vous est interdit de reproduire ou transférer une partie du Bien, quelle qu'elle soit. Vous n'êtes pas autorisé à créer des œuvres dérivées, à tenter de créer le code source à partir du code objet ou à télécharger ou utiliser tout Bien pour tout autre raison que celles expressément permises. Il vous est interdit d'outrepasser, de désactiver ou de contourner un cryptage, une sécurité, un système de gestion de droits numériques ou un dispositif d'authentification du système lié à PSN ou à tout contenu disponible par l'intermédiaire de PSN. Vous acceptez que le PSN, y compris un certain contenu fourni par PSN, puisse contenir des fonctions de sécurité ou techniques pour empêcher toute utilisation d'un tel contenu représentant une violation du présent Accord. Nonobstant tout terme, le Bien n'est pas concédé sous licence pour être revendu, présenté, affiché, distribué ou diffusé au public. Vous acceptez que certains fournisseurs de contenu et concédants de licence sont des tiers bénéficiaires de l'application de ces Termes, et se réservent ainsi le droit de les faire valoir à votre égard et à l'égard de vos utilisateurs autorisés par le biais de l'application du présent Accord. Sauf comme expressément autorisé par le présent Accord, SCEA et ses concédants se réservent tous les droits, intérêts et recours relatifs à PSN et au Bien.

Des conditions d'utilisation supplémentaires peuvent s'appliquer à un contenu particulier. Il se peut que les conditions d'utilisation ou les modalités de licence soient plus restrictives, selon le contenu. Veuillez étudier attentivement toutes les conditions d'utilisation relatives à un contenu spécifique avant un achat. Les restrictions s'appliquant à un contenu ou service sont soumises à la seule décision de SCEA ou de ses concédants de licence et sont susceptibles d'être modifiées à tout moment. L'utilisation des termes "achat", "vente", "vendu(e)", "vendre" ou "acheter" sur PSN ou relativement à PSN ne signifie ni n'implique, par les présentes, un quelconque transfert de propriété d'un contenu, de données ou d'un logiciel ou de tout droit de propriété intellectuelle de SCEA ou de ses concédants de licence, à un utilisateur ou un tiers. Tous les autres logos et noms de sociétés, produits et services cités en référence sur PSN sont les marques, les noms commerciaux, les marques de commerce/service et les marques de commerce/service déposées ("Marques") de leurs propriétaires respectifs. Vous ne pouvez pas utiliser ou reproduire une Marque quelconque sans le consentement exprès par écrit de son propriétaire. Vous n'êtes pas autorisé à retirer les avis de droit d'auteur ou les étiquettes de tout contenu.

9. CONTENU VIDÉO

Sous réserve des conditions et modalités du présent Accord et de toute clause ou condition supplémentaire concernant le contenu particulier, SCEA vous concède, sous licence, le contenu numérisé des programmes, y compris les émissions télévisées et les films ("Contenu vidéo") pour une visualisation exclusivement au titre personnel, privé et non-commercial, aux États-Unis, et uniquement sur un nombre limité de systèmes informatiques de loisir interactif activés PLAYSTATION®3 et de systèmes PSP® (PlayStation®Portable) ("Appareil autorisé"), et ce, durant la période de visualisation autorisée ("Terme autorisé"). Le contenu vidéo peut être mis à votre disposition sous la forme de location ou d'achat. Vous pouvez louer le contenu pour une durée limitée ("Contenu en location"), ou le visionner continuellement conformément à certaines règles de gestion des droits numériques et selon les conditions et modalités du présent Accord ("Contenu acheté"). En dehors des droits qui vous ont été spécialement accordés, tous ceux qui sont liés au contenu vidéo sont réservés par SCEA ainsi que par ses concédants de licence tiers.

Une seule copie du Contenu en location peut être visionnée sur un Appareil autorisé pendant 24 heures maximum à compter de la lecture initiale, ou pendant 14 jours après le paiement du Contenu en location, selon la plus rapprochée de ces deux périodes. Après quoi, il ne vous sera plus possible de visionner le Contenu en location. Le Contenu en location ne peut pas être reproduit. Toutefois, le Contenu en location en définition standard originairement téléchargé sur un système informatique de loisir interactif PLAYSTATION®3 peut être transféré une fois, par le biais du compte PSN ayant permis l'achat de ce contenu, sur un système PSP® (PlayStation®Portable) activé durant le Terme autorisé. Par la suite, le Contenu en location ne sera plus disponible sur le système informatique de loisir interactif PLAYSTATION®3 d'origine, et aucun autre transfert sur tout autre appareil, y compris un système de loisir interactif PLAYSTATION®3 ou système PSP® (PlayStation®Portable), ne sera autorisé. Le Contenu en location en définition standard originairement téléchargé sur un système PSP® (PlayStation®Portable) peut être visionné sur un (1) seul système PSP® (PlayStation®Portable) activé durant le Terme autorisé. Le Contenu en location en haute définition peut être visionné sur un (1) seul système informatique de loisir interactif PLAYSTATION®3 activé.

Vous pouvez visionner du Contenu vendu autant de fois que vous le souhaitez sur un Appareil autorisé. Le Contenu vendu en définition standard originairement téléchargé sur un système informatique de loisir interactif PLAYSTATION®3 peut être copié uniquement par le biais du compte PSN ayant permis l'achat de ce Contenu vendu pour être utilisé sur un maximum de trois (3) systèmes PSP® (PlayStation®Portable) activés. Le Contenu vendu en définition standard originairement téléchargé sur un système PSP® (PlayStation®Portable) peut être visionné sur deux (2) autres systèmes PSP® (PlayStation®Portable) activés. Le Contenu vendu en haute définition peut être visionné sur un (1) seul système informatique de loisir interactif PLAYSTATION®3 activé.

Une activation appropriée du système informatique de loisir interactif PLAYSTATION®3 ou du système PSP® (PlayStation®Portable) par le compte PSN ayant permis l'achat du Contenu vidéo est nécessaire pour tous les téléchargements, transferts, copies et affichages. L'achat de tout Contenu vidéo est lié au compte PSN ayant permis l'achat, et tout les comptes PSN ne peuvent activer plus d'Appareils autorisés que le maximum autorisé par le présent Accord ou par les termes et conditions du Contenu vidéo en question, quel que soit le nombre de copies du Contenu vidéo achetées à l'aise du compte PSN. SCEA se réserve le droit de limiter le nombre d'activations ou de désactivations de tout système informatique de loisir interactif PLAYSTATION®3 ou système PSP® (PlayStation®Portable).

Le téléchargement en dehors du Terme autorisé n'est pas autorisé. De plus, une fois que le Contenu vidéo a été téléchargé de PSN, il ne vous sera plus possible de le télécharger à nouveau, pour quelque raison que ce soit, sans acheter une nouvelle copie.

Certains contenus vidéo tels que les bandes-annonces, peuvent ne pas être très représentatifs du film réel. Des versions numérisées de certains contenus peuvent être différents du contenu formaté d'origine ou de versions antérieures d'un contenu portant le même nom.

Le Contenu vidéo peut être visionné sur des écrans capables d'afficher des résolutions allant de standard à 1080p, selon le contenu. La sortie vidéo à certains formats peut nécessiter un matériel supplémentaire vendu séparément.

10. ABONNEMENTS

Les abonnements ne peuvent être répartis entre des comptes PSN, notamment le Compte principal avec ses Comptes secondaires associés. Tous les abonnements seront renouvelés automatiquement, sauf si vous annulez l'abonnement. Lors du renouvellement automatique, si votre portefeuille n'affiche pas un crédit suffisant pour couvrir les frais de renouvellement automatique de l'abonnement, votre abonnement sera résilié. Si les fonds crédités à votre portefeuille ne sont pas suffisants et que vous avez saisi les informations de facturation de votre carte bancaire, cette dernière sera automatiquement débitée d'un montant minimum défini par SCEA afin de renouveler automatiquement votre abonnement, même si le montant débité est supérieur au montant des frais d'abonnement. Toute différence entre le montant débité et la somme des frais d'abonnement et du solde actuel sera portée au crédit de votre portefeuille. Les frais d'abonnement peuvent être augmentés à la fin de chaque période d'abonnement. Lorsque les frais ont été augmentés, il vous sera demandé de confirmer si vous désirez maintenir l'abonnement. Vous avez la possibilité d'annuler les abonnements par le biais de la section Gestion du compte PSN. L'annulation entrera en vigueur à partir du renouvellement suivant de cet abonnement. Sauf disposition contraire du présent Accord, vous ne recevrez aucun remboursement au titre d'un abonnement payé d'avance.

11. MAINTENANCE ET MISES À JOUR (À NIVEAU)

Afin de vous fournir certains contenus, SCEA peut être amenée à s'assurer, de temps à autre, que PSN, votre système de loisir interactif PLAYSTATION®3, votre système PSP® (PlayStation®Portable) ou autre matériel agréé par SCEA fonctionne correctement, conformément aux directives de SCEA. Certains contenus peuvent être fournis automatiquement sans préavis, lors de votre connexion à PSN. Ces contenus peuvent inclure des mises à jour ou mises à niveau automatiques pouvant modifier votre système d'exploitation, occasionner une perte de données ou de contenus ou occasionner une perte de fonctionnalités ou d'utilitaires. Ces mises à niveau ou mises à jour peuvent être fournies pour le logiciel système de votre système de loisir interactif PLAYSTATION®3, de votre système PSP® (PlayStation®Portable), ou autre matériel agréé par SCEA. L'accès à un logiciel système ou son utilisation sont soumises aux modalités et conditions d'un contrat de licence utilisateur distinct pouvant être consulté à l'adresse http://www.us.playstation.com/termsofuse. Vous autorisez SCEA à fournir de tels contenus et vous acceptez que SCEA ne soit pas tenu responsable des dommages découlant de la fourniture de tels contenus ou services de maintenance. Il est recommandé de sauvegarder régulièrement les données se trouvant sur le disque dur et susceptibles d'être sauvegardées.

12. ÉLÉMENT UTILISATEUR ET INFORMATIONS

SCEA peut fournir à des tiers, y compris ses sociétés apparentées ou filiales, des informations relatives à votre participation au PSN, y compris vos communications et méthodes de jeu obtenues par le biais de PSN ("Informations"). Par les présentes, vous autorisez SCEA à utiliser, distribuer, copier, afficher et publier vos Informations à toute fin commerciale légitime, y compris les tournois et le classement, sans vous verser de rémunération. En outre, vous aurez la possibilité de publier, diffuser en flux ou transmettre des images, des photographies, des éléments de jeu ou d'autres informations par le biais de PSN pour les partager avec d'autres personnes ("Éléments utilisateur"), sous réserve qu'aucun droit d'autrui ne soit violé. Excepté dans les limites permises par la législation en vigueur, vous autorisez SCEA et lui concédez le droit perpétuel d'utiliser, de distribuer, de copier, de modifier, d'afficher et de publier vos Éléments utilisateur pour n'importe quelle raison, et ce, sans restriction ou compensation d'aucune sorte à vous ou quiconque d'autre. Vous autorisez également SCEA à accorder une sous-licence de ses droits à toute tierce partie, y compris ses filiales et sociétés apparentées. Vous renoncez ici à toutes les réclamations, notamment les droits moraux, contre SCEA, ses filiales et sociétés apparentées relatives à l'utilisation par toute tierce partie des Éléments utilisateur dans la mesure permise par la loi applicable. En publiant, diffusant en flux ou en transmettant un Élément Utilisateur, vous déclarez et garantissez que vous détenez les droits nécessaires pour utiliser, publier, distribuer et transmettre l'Élément Utilisateur et pour concéder à SCEA la licence précédente. Vous vous engagez également à coopérer avec SCEA pour régler tout litige découlant de vos Informations ou Éléments Utilisateur. SCEA se réserve le droit, à son entière discrétion, de supprimer toute Information ou tout Élément utilisateur.

Certains jeux joués sur ou disponibles par PSN peuvent avoir des fonctionnalités permettant à vos informations, y compris les données de jeu, l'ID PSN, les listes d'amis, les messages et autres informations liées au jeu, d'être enregistrées par un utilisateur et distribuées publiquement à n'importe quelle tierce partie, y compris à des utilisateurs ne faisant pas partie de PSN. Vous acceptez que n'importe quelle tierce partie puisse enregistrer, utiliser et distribuer lesdites informations pour quelque raison que ce soit sans aucune restriction ou compensation à vous. Des termes et conditions supplémentaires peuvent s'appliquer, y compris la charte de confidentialité de SCEA et les termes et conditions de tout éditeur de jeu ou fournisseur d'accès à ces jeux. Veuillez examiner les termes très soigneusement. Si vous ne voulez pas que vos informations soient utilisées, enregistrées ou distribuées, ne jouez pas à ce jeu en ligne sur PSN.

Durant votre utilisation de PSN, des informations sur des produits ou des services de SCEA ou d'autres tierces parties peuvent vous être présentées. Ces informations incluent, mais sans s'y limiter, des promotions, des publicités, des mises en place de produits ou des supports de marketing sur PSN ou visibles au cours d'un jeu, que le jeu en question soit ou non lié à ou fourni par PSN. Vous acceptez que SCEA et ses partenaires commerciaux et fournisseurs d'accès puissent recueillir des informations relatives à vos activités, vos accès et vos méthodes de jeu, et qu'ils puissent distribuer ces informations dans le respect de la charte de confidentialité de SCEA ou de celles des tierces parties si applicable. SCEA n'endosse aucunement les produits ou services des tierces parties dans le cadre de toute publicité, promotion ou marketing.

13. RÉSILIATION/ANNULATION

Si SCEA juge, à son entière discrétion, que vous avez violé une disposition du présent Accord, du Contrat de service ou d'autres conditions d'utilisation ou contrats liés au PSN, ou que avez nui ou porté atteinte à la communauté de PSN, SCEA prendra toutes les mesures qui s'imposent pour protéger ses intérêts, notamment par la résiliation ou la suspension de votre compte PSN (le Compte principal et tout Compte secondaire associé), le retrait et le blocage automatique des contenus, la mise en œuvre de mises à jour ou de dispositifs ayant pour objet de mettre fin à l'utilisation non autorisée ou le recours à toute autre action corrective, selon qu'il sera nécessaire, pour remédier à la violation. Si votre violation est liée au contenu que vous avez téléchargé, vous devez immédiatement arrêter l'utilisation d'un tel contenu et supprimer toutes les copies de tous vos appareils. En cas de résiliation, pour quelque raison que ce soit, vous ne recevrez aucun remboursement pour les articles achetés, la valeur accumulée sur des éléments de jeu ou pour tout solde inutilisé de votre portefeuille, sauf comme expressément stipulé dans le présent Accord et dans les limites permises par la législation en vigueur. Les classements, les scores et les informations liés à PSN ne pourront être retenus ou accessibles ni par vous ni par les Comptes secondaires associés. SCEA se réserve le droit d'engager des poursuites judiciaires et de participer à une action en justice ou une enquête, privée ou publique, concernant votre conduite, pouvant exiger la divulgation de vos informations. Sauf disposition contraire du présent Contrat, SCEA peut suspendre ou interrompre, à son entière discrétion et pour une période indéterminée, l'un ou à l'ensemble des accès au contenu en ligne, notamment lors de services de maintenance ou mises à niveau, à tout moment et sans préavis ni obligation préalable.

14. DISPOSITIONS JURIDIQUES GÉNÉRALES

SCEA peut, à son entière discrétion et à tout moment, modifier les dispositions du présent Accord, notamment par l'imposition d'une commission relative à la création de comptes PSN. Dès lors que vous avez accepté le présent Accord ou accédé à PSN, vous reconnaissez être lié par les conditions en vigueur de l'Accord. Pour accéder à la version imprimable de la version en vigueur du présent Accord, cliquez sur http://www.us.playstation.com/termsofuse depuis votre ordinateur personnel. Si des modifications importantes sont apportées au présent Accord, vous en serez informé par un message qui s'affichera lors de votre connexion à PSN. Le cas échéant, des options supplémentaires concernant ces modifications vous seront proposées. Dès lors que vous aurez continué d'utiliser PSN, notamment par l'utilisation de votre Compte principal ou de vos Comptes secondaires, vous serez réputé avoir accepté ces modifications. Si vous refusez d'accepter les modifications apportées au présent Accord, vous pouvez alors nous contacter pour résilier le présent Accord ainsi que votre compte ou vos comptes. S'il reste des fonds dans votre portefeuille à la date résiliation de votre compte par SCEA, ces fonds pourront vous être restitués et vous ne pourrez plus accéder à PSN.

Au cas où toute provision de cet Accord serait jugée illégale ou inapplicable par un tribunal compétent, une telle provision sera supprimée sans avoir aucune incidence sur l'applicabilité des autres provisions et conditions dudit Accord.

Sauf disposition contraire requise par la législation en vigueur, le présent Accord sera analysé et interprété conformément aux lois de l'État de Californie applicables aux contrats exécutés et signés dans l'État de Californie. Sauf disposition contraire requise par la législation en vigueur, les deux parties acceptent de se soumettre à la compétence personnelle des tribunaux de Californie et acceptent que tout litige survenant à l'occasion ou dans le cadre du présent Accord soit porté devant un tribunal du Comté de San Mateo, Californie. En cas de conflit lors de l'application de l'une des parties du présent Accord, tous les coûts et frais, notamment les frais et honoraires d'avocat, seront supportés par la partie qui n'a pas eu gain de cause, et ce dans les limites permises par la législation en vigueur.

15. EXCLUSION DE GARANTIE ET GARANTIE LIMITÉE

Aucune garantie n'est donnée relativement à la qualité, à la fonctionnalité, à la disponibilité ou à la performance de PSN ou de tout contenu proposé sur PSN ou par le biais de PSN. Outre les garanties limitées énoncées dans les Sections 1, 3, 11 et 13 du présent Accord, SCEA exclut expressément toute garantie implicite de commercialisation, d'adaptation à un objet particulier et d'absence de contrefaçon. SCEA n'assume aucune responsabilité quant à l'impossibilité d'acheter ou d'utiliser tout accès à du contenu. DANS LE CAS D'UN MÉCONTENTEMENT OU D'UN DOMMAGE DÉCOULANT DE PSN, DANS LE CADRE DU PRÉSENT ACCORD ET DE LA RESPONSABILITÉ MAXIMALE DE SCEA EN VERTU DU PRÉSENT CONTRAT, DANS LE CADRE DE VOTRE UTILISATION DE PSN OU DE L'ACCÈS À PSN, VOTRE SEUL ET EXCLUSIF RECOURS SERA LIMITÉ À VOS DOMMAGES DIRECTS, SANS EXCÉDER LES FONDS INUTILISÉS DE VOTRE PORTEFEUILLE À LA DATE DE RÉSILIATION. SAUF COMME STIPULÉ DANS LA PRÉCÉDENTE DISPOSITION, SCEA EXCLUT TOUTE RESPONSABILITÉ POUR LA PERTE DE DONNÉES, POUR TOUT DOMMAGE OCCASIONNÉ À VOTRE LOGICIEL OU À VOTRE MATÉRIEL ET POUR TOUTE AUTRE PERTE OU DOMMAGE DIRECT, INDIRECT, PUNITIF, SPÉCIAL OU CONSÉCUTIF, QUELLE QU'EN SOIT L'ORIGINE, SUBI PAR VOUS OU PAR UN TIERS ET RÉSULTANT DU TÉLÉCHARGEMENT DU CONTENU VERS VOTRE SYSTÈME DE LOISIR INTERACTIF PLAYSTATION®3, SYSTÈME PSP® (PlayStation®Portable) OU N'IMPORTE QUEL APPAREIL, DE L'UTILISATION DE PSN OU DE L'ACCÈS À PSN. SAUF SI LA PRÉSENTE DISPOSITION EST INAPPLICABLE DANS VOTRE JURIDICTION, LES PRÉCÉDENTES LIMITATIONS, EXCLUSIONS ET DÉCHARGES S'APPLIQUERONT DANS LA MESURE AUTORISÉE PAR LA LOI APPLICABLE, MÊME SI LE RECOURS EST DÉCLARÉ IRRECEVABLE DANS SON OBJET ESSENTIEL. Les frais dus au Fournisseur d'accès à Internet sont à la charge exclusive de l'utilisateur.
